Ohio’s only remaining abortion clinic is facing punishment by the state after clinic staff drove a woman to the hospital instead of calling the ambulance as emergency prodigal requires.

Toledo Capital Care now faces a $40,000 fine following an April, 2017 Ohio Department of Health (DOH) inspection revealing that the clinic staffed failed to follow its own emergency procedure, according to The Blade. Dr. Ann Nunnally performed an abortion on an anonymous woman nearly 12 weeks pregnant and became worried that the procedure may have caused the woman’s uterus or bowel to perforate.

Rather than immediately call for an ambulance however, the doctor reportedly consulted the woman and her partner, neither of whom had enough money for a cab. The doctor recounts that she determined the event did not warrant emergency services, hence her decision to send the woman to the hospital in the clinic’s own vehicle. She added that she did not want the woman to walk to the hospital.

“Someone suggested one of the staff might be able to take her and I said that’s fine,” Nunnally said. “Because she was stable, I did not feel like it was a life-and-death emergency,” she added. The patient was taken to ProMedica Toledo Hospital and endured no major complications resulting from the abortion.

In addition to the clinic violating emergency procedure, Toledo Capital Care also failed to provide the paperwork requested by Ohio’s DOH on April 11, 2017.

The clinic previously closed the state’s Supreme Court upheld the Ohio Department of Health’s January order revoking the license of Toledo’s Capital Care abortion clinic because it repeatedly failed to produce a written transfer agreement with a hospital for emergency cases where women undergoing abortions need immediate transportation to a nearby hospital. The clinic’s license was reinstated on May 8. (RELATED: Toledo’s Only Remaining Abortion Clinic Resumes Operations)

State inspectors also found 24 violations at the abortion clinic in the past 10 years, according to The Columbus Dispatch.
