Rudy Giuliani hinted Saturday that he believes there is a constitutional crisis, although it isn’t the one that Democrats have been talking about since the release of the Mueller report.

“The threat to the system comes from the four or five Dem hearings disguised as oversight,” Giuliani tweeted. “They deny they are impeachment so they are then investigatory to supplant DOJ, FBI, IRS. It violates separation of powers. Executive branch enforces law not Legislative.”

Citing the separation of powers, the former New York City mayor appeared to argue that House Democrats were calling for hearings — many into issues already addressed in both special counsel Robert Mueller’s report and Attorney General William Barr’s response — in an effort to reach a different outcome.
Giuliani also noted that the way the hearings were being handled was indicative of “harassment,” explaining that the overlap in the requested documents and witnesses would “take enormous time away from the time to govern.”

Democratic New York Rep. Jerry Nadler had argued earlier in the week that Barr’s refusal to comply with a subpoena demanding the full, unredacted Mueller report was indicative of a constitutional crisis. “Now is the time of testing,” Nadler said. “Whether we can keep a republic or whether that republic is destined to change into a different, more tyrannical form of government, as others have over the years.”
The DOJ said that Barr could not turn over the report, saying that it was impossible “to comply with the House Judiciary Committee’s subpoena without violating the law, court rules, and court orders.”
The president has indicated that the White House reserves the right to fight further investigation, arguing that the concessions made in order to facilitate Mueller’s investigation were enough.
