A federal judge has refused a request for a temporary restraining order against the election integrity group Clean Elections USA and its founder, Melody Jennings, in an opinion released Friday.
Arizona Alliance for Retired Americans requested a temporary restraining order against Clean Elections USA for its founder’s public call for citizens to assemble at ballot drop boxes and surveil voters, US District Judge Michael T. Liburdi wrote in the opinion. The retiree group claims that Jennings and her organization engaged in voter intimidation.
“Plaintiffs have failed to show that they are likely to succeed on the merits. While there are serious questions implicated, the Court cannot provide preliminary injunctive relief without infringing core constitutional rights,” the judge wrote in the opinion.

“Further, while the irreparable harm factor tips in favor of Plaintiffs, the balance of the equities and public interest do not. A preliminary injunction cannot issue on these facts, but Arizona Alliance is invited to return to this Court with any new evidence that Defendants have engaged in unlawful voter intimidation,” the judge added.
