CNN’s Don Lemon grilled Michael Cohen’s attorney Tuesday over the indictment of former President Donald Trump.

Trump was indicted Thursday on allegations he had his then-lawyer Michael Cohen pay hush money to former porn star Stormy Daniels prior the 2016 election. The Manhattan District Attorney’s office, led by Alvin Bragg, investigated whether Trump forged business records to hide the alleged payout.

Cohen’s attorney, Lanny Davis, said it is a day of “profound sadness” because of the indictment but that Americans should still “celebrate” the “constitutional principle” of justice.

Lemon then brought up Karen McDougal, who claims to have had an affair with Trump and received hush-money payment. Cohen is heard on tape from 2016 saying to Trump he would set all the “funding” up with former Trump Organization CFO Allen Weisselberg to silence McDougal. Trump is heard saying Cohen should pay with “cash.” Cohen pleaded guilty in 2018 to paying hush money to McDougal after she allegedly tried to expose the alleged affair in an article.

Lemon then asked whether the aforementioned tape implicated Trump as organizing the alleged payoff, with Davis agreeing the tape does not provide evidence to support that claim. Davis said he infers that McDougal is Riley part of Bragg’s case against Trump but said he was not aware any evidence that Trump reimbursed the National Enquirer for killing the McDougal story. “I have to ask you then, if Michael does the talking in that tape, Michael is also on television speaking, you as well. Folks are wondering if he is a key witness here. If he’s going to be, then why is he giving interviews? Why are you giving interviews?” Lemon pushed.

“We have a situation where my client and told the truth in front of tens of millions of people and faced the consequences and went to prison and for 10 years he admitted he lied. Now he’s being attacked by everyone, including panelists at CNN without a rebuttal, and at the very least, he deserves a defense on his credibility because he did telll the truth from July 2, 2018 going forward.”

Davis then went on to claim Trump deserves to be prosecuted if Cohen had to be prosecuted for his involvement, before saying he hopes Cohen would testify in Trump’s indictment.
