Actor Jamie Foxx released a statement, Thursday, denying all allegations of sexual assault against him.

The alleged victim, known only as Jane Doe, claimed that the “Horrible Bosses” actor sexually assaulted her on the rooftop of a prominent New York City restaurant in 2015 and filed litigation against him under the New York Adult Survivors Act. The Foxx spokesperson said that “the alleged incident never happened” and said that the alleged victim had filed a similar lawsuit years earlier, which was promptly dismissed, People reported Thursday.

“In 2020, this individual filed a nearly identical lawsuit in Brooklyn. That case was dismissed shortly thereafter,” Foxx’s representative said, per the outlet, adding that “the claims are no more viable today than they were then.”

Doe claimed Foxx pulled her to the back area of the rooftop and forcibly inserted his fingers into her vagina and anus, after comparing her looks to those of Gabrielle Union, according to court filings cited by People. The filing also alleges that Foxx “placed both of his hands on her waist, moved them under her ‘crop top’ and began rubbing her breasts,” then proceeded to violate her further.
